Ep. 1325 Articles of Impeachment Against Abraham Lincoln

137 ratings | 2415 views
A law professor recently included a thought experiment on a constitutional law exam: suppose Lincoln had survived the assassin's bullet, and later wound up facing articles of impeachment for some of his actions during the war. This is obviously a useful exercise, since many people feel an emotional connection to Lincoln and his cause, but this is precisely what law school is supposed to be about: can you suspend such thoughts and think entirely about the law? Well, guess how one critic characterized the exam. You already know the language used to condemn it. Brion McClanahan and I review the accusations against this professor, and the extremely valuable and thought-provoking questions on his exam. You should do your OWN articles of impeachment....1. trying to arrest supreme court justice for saying habeus corpus is suspended in war. <--war crimes?

ehhhhh, as a person of Irish descent, I am really tired of white supremacy argument. As you most certainly know, MY people were not considered white till maybe after WW2. Further my ancestors got here just before the civil war and then put into slavery by first draft, and if we refused AND we did by riots in 2 cities, shot dead to go fight a war to collect their taxes.

+Yiffox >Because there was no such thing as "white" in 1776. Also not true. One of the first legislative acts of the first U.S. Congress was the Naturalization Act of 1790, which stipulated that one must be a free white person of good character to become a citizen of the United States. If Irishmen were not considered white, they would not have been eligible for citizenship. https://en.wikipedia.org/wiki/Naturalization_Act_of_1790

+LucemExTenebris Because there was no such thing as "white" in 1776. They were Irishmen and Englishmen, and they probably represented the Catholic state of Maryland or were propertied landowners. When the idea of "whiteness" started coming about scientifically due to Darwinism in late 1800s, the only white people were Germanic and Nordic people. Irishmen, SOuthern and Eastern Europeans were not white and first immigration policies started to keep Irish and Italians out specifically. The KKK in the north was specifically against Catholics (Irish and Italians) who were "takin their jobs".

>As you most certainly know, MY people were not considered white till maybe after WW2. This is just not true. There were many Irishmen in America before the founding of the United States, and indeed four of the delegates to the Constitutional Convention were born in Ireland. How could this be if the Irish weren't considered white?

The guy criticizing the alternate reality Lincoln Impeachment follows the frame work of post-modernism and critical theory. - Conflate Racism with everything you don't like. - Decry Logic. - Screech buzzwords to delegitimize your opponent. - Project onto your opponent ("he's got white fragility).

Racism should not be conflated with race realism. The recognition that the races are different and that race mixing is not racist, it is simply a recognition of biological reality.

I don't know why people get so upset about racism. Just because I hate 5ks, 10ks, half- and full-marathon races doesn't make me a bad guy. I just like running on my own. I should be allowed to hate whatever races I want. Car racing is ok.

I hate it when Libertarians put up creazy weak arguements, the difference between the patriot act and Japanese internment camp is, A, it was not a war against a foreign power or an unknown power, it was a battle on US soil, sorry but that is different. B. It was a military tool to bring victory in a war on our soil, C. It only applies to the enemies of the constitution, those that passed their own constitution that maeant they were a combatant, you cannot say you are against the constitution, make your own constitution then say you are protected by the constitution. If they could shoot southerners they they could confiscate property, since slaves were treated as property they could be freed.
