New delhi: if an unmarried couple is living together as husband and wife, then they would be presumed to be legally married and the woman would be eligible to inherit the property after death of her partner, the supreme court has ruled. "it is well settled that the law presumes in favour of marriage and against concubinage, when a man and woman have cohabited continuously for a long time. However, the presumption can be rebutted by leading unimpeachable evidence. A heavy burden lies on a party who seeks to deprive the relationship of legal origin," the bench said. The supreme court has since 2010 consistently ruled in favour of couples living together as husband and wife, giving the woman the right of a wife. The court passed the order in a property dispute where family members contested that their grandfather, who was living with a woman for 20 years after his wife's death, was not legally wedded to the woman and she was not entitled to inherit the property after his death. They contended that she was their grandfather's mistress. I was pretty surprised by all of this and of course ! Why is this the case ? There is no one single reason why but a bunch of different reasons that contribute to it. Constraints One reason why is simply constraints. Living together can make it more difficult and less enticing for a couple to break up with one another. By living together you may have shared financial comments such as a lease, increases the difficulty of moving out because you need to find another place to live and your going to experience increased social pressure from your friends and family who are probably asking you when your going to get married and expect you two to take the next step together eventually. All of this can lead to couples sliding into marriage when if they didn’t live together would have broken up. Which means you are in a marriage where there is a real higher chance of divorce. One key differentiation though is commitment Commitment There was a difference between the couples who had made a mutual decisions to marry BEFORE living together and people who decide to marry AFTER they start living together. In a study they found that those who lived together without having made a decision to marry had more • More negative interactions • Lower relationship quality • Lower relationship confidence. On the other hand those who started lived together with a mutual commitment to marriage didn’t have any significant differences compared to those who started living together after marriage. Basically, living together may be a more risky choose primary for those who don’t have plans to marry/ Another food for thought would be that if you feels the need to cohabit to test the relationship, maybe that’s a sign already that the relationship is a poor fit. Summary Basically the big take away is to really think about whether you should live together and avoiding sliding into it vs deciding. Really think it through and making sure that BOTH parties understand what it means to live together. Those who slide into living together are going to have all the constraints that similar to being married but on shakier relationship grounds because the commitment isn’t there. A critical part of relationship development Here are some of the suggested questions you could ask yourself or your partner if you want to live together. 1. What does/did living together mean to you and mean for the future of your relationship? 2. Where do you see this relationship going in the future? What sort of timeline do you expect? 3. How do you each show you are committed to the other? 4. Do you believe that one of you is more committed than the other? What indicates to you that there is a difference? How will this affect how your future together plays out? 5. How have the two of you made important decisions together in the past?

Do unmarried couples have the same rights as married couples? : Some unmarried couples are under the mistaken belief that they are “common law” husband and wife and therefore upon relationship breakdown they will have the same or similar rights to a married couple upon divorce. This is a myth and there is no such thing as a “common law” spouse. Though it is not illegal for unmarried couples to stay together, it is at the discretion of the hotels, to allow or not to allow unmarried couples to stay in their hotel. Why unmarried couples are not allowed in hotels?: Many hotels will not allow unmarried couples to stay at their hotel simply in order to save their image from being degraded and police harasment, and not because there is any law against unmarried couples. Luxury Hotels (or simply costly hotels) do not bother with such issues and the police interference is minimal. Can an unmarried couple stay in a hotel in Dubai?: Islamic law prohibits unmarried couples from living together. The same rule applies to sharing a hotel room. LAT is also increasingly understood and accepted publicly, is seen by most as good enough for partnering, and subject to the same expectations about commitment and fidelity as marriage or cohabitation. Within Asia, "walking marriages" have been increasingly common in Beijing. Guo Jianmei, director of the center for women's studies at Beijing University, told a Newsday correspondent, "Walking marriages reflect sweeping changes in Chinese society." A "walking marriage" refers to a type of temporary marriage formed by the Mosuo of China, in which male partners live elsewhere and make nightly visits. A similar arrangement in Saudi Arabia, called misyar marriage, also involves the husband and wife living separately but meeting regularly.

Should you cohabitate or wait? In today’s world it is not uncommon to hear of young couple wanting to “make sure” that they “suit each other” before they make the commitment to marriage. Many want a test run with supposedly no strings attached prior to marriage—if marriage is even a consideration at all. You may not realize that those who cohabitate prior to marriage actually have a much higher (50-80% higher) chance of divorcing rather than those who marry without first living together. Cohabitation removes the formal commitment that defines marriage. It gives each party an “easy out” in case things get difficult. Today's video is brought to you by Tatu. Again no specific topic they wanted me to cover so today I'm going to cover the insane idea of Living Apart Together. This is the latest demographic scheme I believe being cooked up to enslave men further to the state and women. This is a term that's being talked about in Britain and it's about couples that have an intimate relationship but have separate addresses. But obviously it applies all over the world. The government in Britain estimates that ten percent of all couples in that country are together but living apart in separate residences. And other western countries estimate that six to nine percent of couples live apart. And I even found an article up here in Canada talking about it and I'm putting it in the description below. What good are couples that live apart. They don't sign marriage contracts that can later be used against men. And if they don't live together then common law doesn't apply to them either. Governments and lawyers want couples fighting each other in the courts for assets because the more they do the more the government collects in taxes from legal fees. The more the judges get paid, the more real estate agents make money and pay tax once family estates are liquidated. Here in Canada a married couple can only have one piece of real estate that is considered the matrimonial home and therefore can be sold tax free. But if a couple doesn't marry they have two tax free homes they can liquidate and not have to pay capital gains tax on both properties. The gynocentric government here in Canada has pushed men away from marriage, then away from co-habitation and towards a lifestyle where they live apart from their partners. In a lot of cases, such couples are even blamed for engaging in prostitution. It made headlines when the Police broke into hotel rooms in Mumbai. They arrested some 40-odd couples found in these rooms. The police not only charged these couples with ‘indecent behavior.’ and called the parents of these couples but also charged Rs. 1200 as fine with morality lessons. All these couples were young adults. Anyone over the age of 18 can legally consent for any kind of physical relationship. Then what was their crime? The crime was that they were unmarried couples. According to the Police, unmarried couples spending time together in a hotel room is ‘immoral.’ What Does the Law Say About it? All the moral and actual policing would make you think that staying in hotel rooms is illegal in India if you are an unmarried couple. But there is no law in India that says this. Yes, there is not a single law that says unmarried couples cannot stay together or book a hotel room. This is not all. Refusing to let out a hotel room to someone because of their marital status is a violation of fundamental rights. Time and again, the Supreme Court has said that it is legal for unmarried couples to stay together. Then why do hotels refuse to let out a room to an unmarried couple? Also, why does the Police arrest such couples? The answer is simple. Hotels refuse because they fear the Police. The Police arrests because they love to teach ‘moral’ lessons to young couples. The only exceptions to this rule are five star and other high-end hotels. These hotels do not ask any uncomfortable questions to their guests, nor do they ask for identity or marriage proofs. While the average age of first marriages is higher than ever before, more Americans are cohabiting and having children outside of marriage, according to recent data from the Pew Research Center and the Center for Disease Control. In February 2018, the Pew Research Center reported that the median age of marriage in the United States was 29.5 years for men and 27.4 years for women in 2017. These are the oldest median marriage ages on record. Perhaps unsurprisingly, the percentage of cohabiting Americans is also climbing. Last month, the Institute for Family Studies discussed a study on cohabitation released by the Center for Disease Control’s National Center for Health Statistics. The IFS concluded that 64.5 percent of participants in a study of Americans age 18-44 had “cohabited with a romantic partner at some point outside of marriage.” “Other estimates not based on this specific report are that the percentage of people living together before tying the knot is now at an all-time high of over 70 percent,” the IFS reported. Calling cohabitation a socially “normative behavior,” the article noted an 82 percent increase between 1987 and 2010 of women who have cohabited at some point, as reported in a study by demographer Wendy Manning. Cohabiting couples are also increasingly more likely to have children. There has been a 15 percent increase in cohabiting parents from 1997 to 2017, a Pew Research study found. “Due primarily to the rising number of cohabiting parents, the share of unmarried parents who are fathers has more than doubled over the past 50 years,” Pew reported. “Cohabitation has greatly increased in large measure because, while people are delaying marriage to ever greater ages, they are not delaying sex, living together, or childbearing,” the IFS said, noting that “almost all of the increase in non-marital births in the US since 1980 has taken place in the context of cohabiting unions.”

In some ways, such a couple may be treated like a married couple, such as when applying for a mortgage or working out child support. However, in some other areas, such as property rights, pensions and inheritance, they are treated differently. A cohabitation agreement contains documentation for a couple who want to live together in order to protect themselves from unnecessary cost and litigation should their cohabitation break down. They can clearly regulate their property rights and what arrangements might be made for mutual financial support, dealing with debt, caring for children, etc. The agreement also, much like a prenuptial agreement, allows the individuals concerned to determine in advance who will keep specific assets and what will happen to assets that have been purchased jointly if they separate. This agreement is intended to bind both parties. In the United States, about 15 million couples qualify as cohabiting. A cohabitation agreement can give each party an idea of the expectations of the relationship with the legal enforceability to protect against financial ruin or the loss of support that was promised. It is a good idea in that if the couple does break up, an altercation about who receives what may be less likely. However, the courts may occasionally change or ignore provisions set out in a cohabitation agreement if they feel that they are inadequate under the circumstances. Cohabitation agreements are not considered to be legally binding in the United Kingdom. A cohabitation agreement will usually not be adequate to settle all legal issues that might arise, so a trust deed setting out property rights and a will are also recommended. It is a common misconception that there is a doctrine of "Common Law marriage" in English law. That is to say that without having married, there is no automatic right to home ownership, even if the home is shared for a long time. Instead, the only way in which ownership can be obtained is through ordinary trust law. Interestingly, even if the parties are legally married, there is still no automatic right to home ownership. Instead, any transfer of ownership will be at the discretion of the court when exercising their power under the Matrimonial Causes Act 1973. In Canada, each province has legislation which governs the creation of cohabitation agreements. In the Province of Ontario there are restrictions on what can be included in such agreements. For example, clauses requiring chastity are unenforceable. Provisions which pre-determine issues of child custody and access as well as child support may be disregarded by a court As well, in Canada, for a cohabitation agreement to be valid, it must be signed, witnessed, and accompanied by financial disclosure. Some gay activists have been campaigning for legal recognition of their partnerships. Their campaigning for the right to take over a partner's tenancy of the family home on bereavement have been gained, regardless of any cohabitation agreement existing, but if a couple share a home their chances of buying the rights are much more limited. In December 2005, the British government offered gay couples equal rights with married couples if they register a civil partnership legally. The government-backed scheme – which enables same-sex couples to qualify for next-of-kin entitlements on inheritance tax, pensions and property – is likely to attract many more couples. There will still be large legal differences between civil partnership and marriage. For example, a couple can get married and have all the legal rights and benefits after knowing each other for only a few days, but a same-sex couple will almost certainly be required to show a lengthy commitment to each other before they are allowed to register their partnership. Currently, for immigration purposes, a same-sex couple must show they have a relationship of two years' standing, and it is likely that a similar term will be imposed for registering a partnership. Consequently, same-sex couples will need to make wills and a cohabitation agreement, to provide security in the event of break-up. In the United States, a cohabitation agreement offers fewer legal protections than a registered domestic partnership. Many couples in the United States choose to live together. In fact, cohabitation has become normative, both as a typical living arrangement and a precursor to marriage. Yet while the media increasingly concurs that cohabitation is “the new normal,” we know very little about how these relationships begin and unfold. At what point in the relationship do people decide to move in together, and why? And what happens afterwards? In a Chats in the Stacks book talk at Mann Library in October 2017, Sharon Sassler, professor of policy analysis and management in the College of Human Ecology, explored insights from her new book, co-authored with Amanda Miller (Dept. of Sociology, University of Indianapolis) to address these questions and highlight impacts of social class and education on romantic relationships in an era of economic uncertainty, and what it means to live together in the 21st century. Professor Sharon Sassler received her Ph.D. in Sociology from Brown University in 1995, and joined the Cornell faculty in the Department of Policy Analysis and Management in 2005. A social demographer, Sassler’s research examines factors shaping the activities of young adults and their life course transitions into school and work, relationships, and parenthood, and how these transitions vary by gender, race/ethnicity, and social class.

Lately, the idea of cohabitation is favored by the younger generations. The growing rates of cohabitation are confirmed by the statistics showing a huge leap from 6% in 1975 to 72% in 2001. Such couples believe that sharing expenses and learning more about each other will help them find out whether their have what it takes for a lifelong commitment. If things don't work out, breaking up is easy with no legal procedures to take. Unfortunately, the younger generation only recognize the social trends that make cohabitation seem attractive, and are not aware of the risks that come along Popenoe and Whitehead, 2014. However, not all cohabitations are the same. Usually prenuptial cohabitations are harmless as the decisions for marriage are already made and as the cohabitation was not arranged for some other functions such as "testing" the partner or as an alternative to marriage. However, cohabitation without marriage plans or as a mere alternative to marriage often bring problems and disadvantages. The dailymail reported that"research by psychologists Scott Stanley and Galena Rhoades found that many couples start cohabiting without clear expectations, a shared commitment to each other or common values and goals. Some of these couples then marry after time because they - or their friends and family- believe it's the logical step to take.", as also mentioned by NYT as "'sliding, not deciding.'... Couples bypass talking about why they want to live together and what it will mean." Thus, these 'sliders' don't always have common values or shared commitment and such couples are 40% more likely to divorce later than those who actively decide to marry before they move in London. Yet, due to the sunk-cost fallacy, many couples tend to tread the treacherous path. Another type of cohabitation is of those who cohabit as an alternative to marriage. Due to higher uncertainty about the relationship's future of cohabiting couples, each partners tends to invest less in their relationship, and are less likely to pool economic resources and specialize in paid and unpaid work Strohm. Such independence unbound by legal contract allows easy break up. However, it's not only about easier dissolutions. Cohabiting couples hold much more disadvantages than married ones. Moreover, despite more independence, women in cohabiting relationships are more likely than women to suffer physical and sexual abuse. Situations are more brooding when children are involved. The average age of those married for the first time is currently 28 for men and 25 for women (National Health Statistics Report, 2012) Compare this to the numbers from 1960 when the median age was 23 for men and 20 for women. 2) Couples who cohabit have a 46% greater risk of divorce than couples who do not live together before marriage (Marriage and the Family in the United States: Resources for Society, 10). Those who cohabit without a prior commitment to marriage are especially at risk if they eventually decide to marry. (see Dr. Scott Stanley, “Sliding vs Deciding” blog) 3) Pregnancy and childbearing prior to marriage significantly increase the likelihood of future divorce. In America, more than one-third (37%) of children are born to parents who are not married and few of these parents eventually marry however most of those parents will separate before the child begins school and some will never really get together. 4) Parents’ divorce. Of course, some risk factors for divorce you can’t control. If you experienced the divorce of your parents, unfortunately, that doubles your risk for divorce. And if your spouse also experienced his or her parents’ divorce, then your risk for divorce more than triples. This is scary, but it doesn’t doom your marriage to failure. It does suggest that individuals who experienced the divorce of their parents need to work even harder to make good marriage choices and to keep their marriage strong and happy. 5) Research shows if you get married after age 27 you have a 57% you will stay married As you can see there are things you can do to increase your chances you will not get a divorce however, Just because you don’t get a divorce does not mean you will have a happy marriage. Researchers have estimated that individuals with annual incomes of more than $50,000 have a lower chance of divorce (compared to individuals with annual incomes less than $25,000). Finances can be stressful. Apparently having at least a modest income can help couples avoid stresses that can lead to divorce. 3) Religious affiliation. Researchers have estimated that individuals who report belonging to some religious group have a somewhat lower chance of divorce than those who say they have no religious affiliation. If couples share the same religious affiliation, their chances of divorce are even lower.
